Terms of use
The short version. What you write is yours, and it stays on your device unless you choose to send it somewhere. Writing is free. The optional subscription is handled by Apple or Google, and you can cancel it there at any time. Keep a backup, because we don't have a copy of your journal.
These terms cover Lueur: One line a day journal and any other apps from Hearthrealm Studio LLC, an Oregon company ("we"). By using one of our apps, you agree to them. The short version above is a summary; the sections below are the terms.
If you downloaded an app from the App Store, Apple's Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, Google Play's terms also apply.
Your content is yours
We claim no ownership rights over anything you write or add in our apps. All of it remains yours. It's stored on your device, and we have no access to it.
Keeping a backup
Your journal is stored on your device and in any backup you choose to make. We don't keep a copy, so we can't recover it if your device is lost, reset, or damaged, or if the app is deleted. Exporting regularly, or turning on Google Drive backup, is the best way to keep it safe.
Google Drive backup
Google Drive backup is optional and off until you turn it on. When you connect it, your backups are stored in your own Google Drive, and your use of Drive is governed by Google's terms. Backups count toward your Drive storage. The app can only reach the files it creates there. We don't control Google's service and aren't responsible if it's unavailable or changes.
Subscriptions
- Some of our apps offer an optional monthly or yearly subscription. In Lueur it's called Lueur supporter. Writing and keeping your journal never require it.
- Prices, and any free trial, are shown in the app before you buy.
- Payment is charged to your App Store or Google Play account when you confirm the purchase. If a plan includes a free trial, any unused part of the trial ends when you buy a subscription.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals, and you keep access until the end of the period you've paid for.
- Refunds are handled by Apple or Google under their own policies.
- Purchases are tied to the store you bought from and can't be moved between the App Store and Google Play.
- We may add, change, or retire subscription features over time. When a subscription ends, everything you've written stays yours and stays readable.
Using our apps
We grant you a personal, non-transferable license to use our apps for your own non-commercial purposes. You may not copy, modify, or redistribute the apps, or reverse engineer them except where the law allows.
We or our licensors own all right, title, and interest in and to our apps, including all intellectual property rights in them, and you obtain no ownership rights in the apps as a result of your use.
Changes to our apps
We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our apps, with or without notice. Whatever changes, what you've written stays yours, on your device and in any backup you've made.
Not a health service
Lueur is a journal. It isn't medical or mental health advice, diagnosis, or treatment. If you're struggling, reach out to a professional or someone you trust. If you're in crisis in the US, you can call or text 988.
Other services
Our apps may link to or work with services we don't run, such as the App Store, Google Play, Google Drive, and the apps you share an export with. Those services have their own terms. We are not liable or accountable for any of them.
No warranty
Your use of our apps is at your sole risk. We provide our apps on an "as is" and "as available" basis, without warranties of any kind, to the extent the law allows.
We design our apps with care and test them before we release them. Still, as with any software, they will have some bugs. We make no guarantees that our apps will meet your specific requirements or expectations, and we don't guarantee they're completely free of errors.
Limitation of liability
To the extent the law allows, you expressly understand and agree that Hearthrealm Studio LLC shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use our apps; (ii) unauthorized access to or alteration of your data; (iii) statements or conduct of any third party; or (iv) any other matter relating to these terms or our apps, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
Where the law doesn't allow that, our total liability for any claim related to our apps is limited to the amount you paid us in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of Oregon, USA. If any part of them can't be enforced, the rest still applies.
There may be times when we don't exercise or enforce a right or provision of these terms. That doesn't mean we're waiving that right or provision.
Changes to these terms
We may update these terms in the future. Whenever we make a significant change, we'll refresh the date at the top of this page. When you use our apps, now or in the future, you're agreeing to the latest terms.
